1. Acceptance of Terms

By accessing or using SOCHEATA ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

SOCHEATA provides an AI-powered face recognition attendance management system for businesses operating in Cambodia. The Service includes face enrollment, automatic attendance tracking, real-time dashboards, and reporting tools.

3. Subscription and Payment

Access to the Service requires a paid subscription. Fees are billed in advance on a monthly or annual basis. All payments are processed through ABA PayWay. Subscriptions auto-renew unless cancelled before the renewal date.

4. Biometric Data

The Service collects and processes facial recognition data (biometric identifiers) for attendance purposes. You are responsible for obtaining lawful consent from all employees whose biometric data is enrolled. SOCHEATA stores face embeddings (mathematical representations) — not raw images after initial processing. You must inform employees in writing before enrollment.

5. Data Ownership

You retain ownership of all company data, employee records, and attendance logs generated through the Service. SOCHEATA does not sell or share your data with third parties except as required to operate the Service.

6. Acceptable Use

You may not use the Service to discriminate unlawfully, surveil individuals without consent, attempt to reverse-engineer the face recognition system, or violate any applicable Cambodian or international law.

7. Termination

We may suspend or terminate your account for material breach of these terms. Upon termination, your data will be retained for 30 days before permanent deletion unless you request earlier removal.

8. Limitation of Liability

SOCHEATA is provided "as is." We are not liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

9. Governing Law

These terms are governed by the laws of the Kingdom of Cambodia. Disputes shall be resolved in the courts of Phnom Penh.
